Terms of Service
What you agree to when you use DigiPages, and what we agree to in return.

1. These terms
DigiPages is operated by DigiPages ( "DigiPages", "we", "us"). You can reach us at support@digipages.io, or by post at Gilbert, AZ 85296, United States.
These terms are an agreement between you and us about your use of the DigiPages website and application. By creating an account or using the service you accept them. If you do not accept them, do not create an account and do not use the service.
These terms govern how you may use DigiPages. They are not the contract under which you buy it — that contract is with Paddle, for the reasons set out in section 4.
2. The service
DigiPages is a hosted notes application. You create pages and folders, write in them, and read them back from any browser you are signed in on. Your pages are stored on our server so they are there the next time you sign in.
There is one product and one set of features. The monthly and annual plans differ only in how often you are billed — neither holds a feature back from the other.
3. Your account
You must be at least 18 years old to hold an account. By creating one you confirm that you are.
Give accurate details when you sign up, and keep your email address current — it is how we verify your account, let you reset your password, and reach you about changes to the service or to these terms.
You are responsible for keeping your password confidential and for everything done through your account. An account is for one person: please do not share your credentials or let anyone else sign in as you. Tell us at support@digipages.io as soon as you think someone else has access to your account.
4. Subscriptions, billing and who you buy from
DigiPages is sold through Paddle, which acts as the merchant of record. When you subscribe, your contract of sale is with Paddle: they take the payment, they are the seller on your receipt and your card statement, and they calculate and remit any sales tax or VAT due where you are. Prices shown on the pricing page include that tax, so the figure you see is the figure you are charged.
A subscription renews automatically at the end of each period — monthly or annually, whichever you chose — until you cancel it. Paddle sends the receipt for every payment.
If a renewal payment fails, Paddle retries it for a short period before giving up. We deliberately leave your access switched on during those retries rather than locking you out over a card that expired, so a transient decline does not cost you your notes. If the payment ultimately fails, the subscription ends and access stops.
5. Cancellation and refunds
You can cancel at any time from your account page, or from the billing portal Paddle provides. You do not have to contact us to do it.
Cancelling takes effect at the end of the period you have already paid for, not immediately. You keep full access until that date, and you are not billed again. We do this rather than cutting access off at the moment you cancel, because cancelling should not forfeit time you have already bought.
Your pages are not deleted when you cancel. The account remains, and resubscribing restores access to everything that was there. If you want your data removed, that is a separate request — see section 9 and our privacy policy.
Refunds. We offer a 14-day refund on a first subscription payment. The full terms, including how to request one and what is not covered, are in our refund policy. Because Paddle is the merchant of record, Paddle issues the refund.
If you are a consumer in the UK or EU you also have a statutory right to withdraw from a distance contract within 14 days. Our refund policy is written to meet that right rather than to sit alongside it, so you do not need to work out which applies — the 14-day policy is available either way.
6. Acceptable use
Do not use DigiPages to store, send or do anything that:
is unlawful, or infringes someone else's copyright, trademark or other rights; is malware, or is intended to damage or gain unauthorised access to any system; harasses, threatens or defames another person; or is material whose possession is itself an offence.
Do not attempt to break, probe or circumvent the security of the service or its billing, access another user's account or data, scrape or bulk-extract content you did not create, place a load on the service designed to degrade it for others, or resell or give away access to your account.
We may investigate suspected breaches and act on them under section 9. Where a breach is also unlawful we may be required to report it.
7. Your content
Everything you write and upload remains yours. We claim no ownership of it.
To run the service we need a narrow permission, and only that: you grant us a non-exclusive, worldwide, royalty-free licence to store your content, serve it back to you, include it in our backups, and make the technical copies needed to do those things. The licence exists to operate DigiPages for you, lasts as long as you keep the content on the service, and covers nothing else.
We do not use your content to train machine-learning models, do not sell it, and do not use it for advertising. If the optional AI features are released, they will process only the specific text you choose to send to them, at the moment you send it.
You are responsible for having the right to store and upload what you put into DigiPages.
8. Availability and changes to the service
DigiPages is provided on an "as available" basis. There is no uptime guarantee. It is run by one person: there will be maintenance, and there will occasionally be unplanned downtime.
We take regular backups, and you should still keep your own copies of anything you cannot afford to lose. Backups reduce the risk of data loss; they do not eliminate it.
Features may change as the product develops. If we make a change that materially reduces what a paid plan does, we will give you reasonable notice by email or in the app, and you may cancel and ask for a proportionate refund of the unused part of the period you have paid for.
Support is by email at support@digipages.io. We answer as quickly as we reasonably can and do not promise a response time we could not keep.
9. Suspension and termination
You can stop using DigiPages at any time by cancelling your subscription, and you can ask us to close your account entirely.
We may suspend or close an account that breaches these terms, is being used unlawfully, or poses a security risk to the service or to other users. Except where the breach is serious, unlawful or urgent, we will tell you what the problem is and give you a reasonable opportunity to put it right first.
If we close your account, we cancel the subscription so you are not billed again, and refund the unused part of any period you have already paid for — unless the closure is for a serious breach of section 6.
What happens to your pages. Closing an account does not by itself erase what is stored. If we close your account we keep your content for 30 days, so it can be restored if the closure was a mistake, and delete it after that. If you ask us to delete your data, we do so within 30 days of the request. Export anything you want to keep before either happens.
10. Disclaimers and limitation of liability
DigiPages is provided as it is, without warranties of any kind beyond those that cannot lawfully be excluded. We do not warrant that the service will be uninterrupted or error-free, or that it will meet a particular requirement.
We are not liable for indirect or consequential loss, loss of profits, loss of business, or loss or corruption of data, to the extent the law allows us to exclude it.
Our total liability to you, for all claims taken together in any twelve month period, is limited to the amount you paid for DigiPages in the twelve months before the claim arose.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.
If you are a consumer, you have statutory rights that these terms do not affect. Nothing here reduces the protection consumer law gives you in the country you live in.
11. Changes to these terms
We may update these terms as the service changes or the law requires. The date they came into force is shown at the top of this page.
For a change that materially affects your rights or what you are paying for, we will give you at least 30 days' notice by email to the address on your account, or in the app. Minor corrections — a clarification, a typo, a changed contact detail — take effect when published.
Continuing to use DigiPages after a change takes effect means you accept it. If you do not accept it, cancel before that date; and if a material change puts you at a disadvantage part-way through a period you have paid for, you may cancel and ask for a proportionate refund of the unused part.
12. Governing law
These terms are governed by the laws of the State of Arizona, United States, and the state and federal courts located in Maricopa County, Arizona have jurisdiction over any dispute arising from them.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may be able to bring proceedings there.
